1. Acceptance of Terms

Welcome to GovConNOW ("we," "us," or "our"). By accessing or enrolling in our courses hosted on the Thinkific platform (the "Course" or "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you and GovConNOW. By clicking "I Agree," creating an account, or accessing Course materials, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

5. Payment Terms

Payment Processing:

• Payments are processed securely through Thinkific's payment system and third-party processors
• You authorize us to charge the payment method provided for all fees

6. Refund Policy

Refund Eligibility:

• Refund requests must be submitted within 30 days of purchase
• Refunds are granted at our sole discretion based on the following criteria:
  • Minimal course progress (less than 25% of content accessed)
  • Technical issues that prevent course access (that we cannot resolve)
  • Duplicate purchases

No Refund Situations:

• After 30 days from purchase date
• If you have completed more than 25% of the Course
• For downloadable resources that have been accessed
• If you violate these Terms of Use

Refund Process: To request a refund, contact [email protected] with your order details and reason for the request. Approved refunds will be processed within 10 business days.

7. Intellectual Property Rights

Our Content:

User-Generated Content:

• You retain ownership of any content you submit (assignments, forum posts, etc.)
• By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, and display your content for educational and promotional purposes
• You represent that your submissions do not violate any third-party rights

8. Acceptable Use Policy

You agree NOT to:

• Share your login credentials or Course access with others

• Any actions you take based on Course information

Maximum Liability: Our total liability to you for any claims arising from these Terms or your use of the Course shall not exceed the amount you paid for the Course in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless GovConNOW, its instructors, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Course
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or share

• Our Courses are hosted on Thinkific's platform
• Your use of Thinkific is subject to their Terms of Service and Privacy Policy
• We are not responsible for Thinkific's services or any issues with their platform

13. Modifications to Terms

16. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GovConNOW regarding the Course.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
